		<description>My comment is no one should be banned for anything.  If you have a modded console you are not hurting anyone else over xbl.  Lets say people are actually changing code on games buring them and then playing them enabling them to do things the game was not intended to (hence cheat) well whoopti whoop, who cares people they ARE JUST GAMES.  MS has so much money and we pay for every DL content on there.  If someone doesnt play fair odnt play with them who cares!!  MS makes so much cash and now they released the elite to piss me off!!! i love my xbox360 and it is not modded but i dont mind for others to do it..</description>

Playing back ups? you mean bootleg games then since I never knew it was legal to play back ups on the 360. People think when they buy a new game system this gives them the right to flash and mod it with out any recourse.

Wow - first of all, actually read what I wrote and mine and Deacon&#039;s subsequent conversation before making yourself look like a jackass.  Second, modding without personal gain or piracy is *not* illegal.  I can think of at least 2 people off the top of my head who had 360s continually scratch their discs and got sick of it because MS wouldn&#039;t repair them because *technically* nothing was wrong with them.  So they flashed and made backups.  Oddly enough it&#039;s something entirely legal with other forms of non-permanent media.  VHS tapes can legally be backed up as long as you don&#039;t distrbute those backups.  Just because Jack Valenti has always had great relations with those in power in the US ever since he was LBJ&#039;s right hand man, that somehow makes it different for digital media?  Bullcrap.  The DMCA has been shot down so many times it&#039;s laughable.

Now, if you had actually read what I said before making your remark, you&#039;d know that I acknowledged Xbox Live as a Microsoft asset and that I believe that they have every right to do whatever the like with it, including restricting access from those who break their contract.  That doesn&#039;t give them the right to put a blanket label of theif/pirate/criminal/cheater/etc. upon anyone who modifies *their own property*.  If you write in a book or highlight it, the publishing company doesn&#039;t brand you a criminal does it?  It&#039;s not a direct analogy, but it applies.</description>
